Xavier Ellsworth Tutoring Services (“Company,” “we,” “us,” or “our”) provides academic tutoring services subject to the terms outlined below. By scheduling, purchasing, or participating in tutoring services, you (“Client,” “Parent/Guardian,” or “Student”) agree to be bound by these Terms and Conditions.

1. Services Provided

Xavier Ellsworth Tutoring Services offers personalized academic instruction across a range of subjects. Sessions are available in person or virtually, as mutually agreed upon. Each session is customized to support the individual learning needs and goals of the student.

2. Scheduling and Cancellations

Scheduling

A 10% deposit is required to secure your session. The deposit will be applied to your balance and is refundable if canceled at least 24 hours in advance.

Appointments are subject to availability and confirmed upon successful booking.

Cancellations

Clients must provide a minimum of 24 hours’ notice to cancel or reschedule a session. Cancellations with less than 24 hours’ notice will incur a cancellation fee equal to 50% of the scheduled session rate.

No-Shows

Failure to attend a scheduled session without prior notice will result in a charge for the full session fee.

3. Lateness Policy

Late Arrivals

Sessions will conclude at the originally scheduled end time, regardless of a student’s late arrival. The full session fee remains applicable.

Excessive Lateness

If a student arrives more than 15 minutes late without advance notice, the session may be canceled at the Company’s discretion, and the full fee will be charged.

Notification

Clients are encouraged to communicate any delays promptly. While session length cannot be extended, early notice allows for potential instructional adjustments.

4. Payment Terms

Payment is due at the time of service unless alternative arrangements have been made in writing.

We accept the following payment methods:
• Check
• Zelle
• Credit/Debit Card (processed via Square)

Cash payments are not accepted.

5. Subscriptions and Package Payments

Clients who purchase session packages or enroll in subscription-based services agree to the full payment terms outlined at the time of booking.

Payment plans may be offered at the discretion of Xavier Ellsworth Tutoring Services and must be completed according to the agreed schedule.

All packages and subscriptions are non-refundable once the first session has been scheduled.

Missed or canceled sessions will count toward the total number of sessions included in the package unless canceled with at least 24 hours’ notice.

Payment Plans

Clients are responsible for making timely payments according to the agreed-upon schedule (e.g., weekly, bi-weekly, or monthly).

Failure to complete payments may result in a pause or termination of tutoring services until the balance is paid.

Late payments may incur a $15 late fee.

By purchasing a package or subscription, clients acknowledge and accept these terms.

6. Former Student Discount

Former students who were previously taught in a classroom setting by any tutor affiliated with Xavier Ellsworth Tutoring Services are eligible to receive a 50% discount on the standard session rate using code FORMER50 at booking.

Discount eligibility must be verified at the time of booking. If eligibility cannot be confirmed, the discount will be revoked and full payment will be required.

7. Sibling Discount

Families booking sessions for multiple children are eligible to receive 15% off sessions for each additional sibling using code SIBLING15 at booking.

All discounts are subject to verification. Unverified discounts will be revoked and full payment will be required.

8. Family Discount

Immediate family members are eligible to receive 40% off the standard hourly rate using code FAMILY40 when booking.

This discount applies to individual or package sessions.

9. Session Conduct

Students are expected to arrive prepared with all relevant materials, including assignments, notebooks, and supplies.

If a student is disruptive or unwilling to participate meaningfully in the session, the Company reserves the right to end the session early. In such cases, no refund or credit will be issued.

10. Parental Involvement

For clients under the age of 18, a parent or legal guardian must authorize participation in tutoring services.

In some cases — particularly during initial sessions — a parent or guardian may be required to be present during in-home or virtual sessions.

11. Academic Outcomes

Xavier Ellsworth Tutoring Services is committed to fostering academic improvement. However, we do not guarantee specific results, grades, or outcomes.

Student progress depends on multiple factors, including engagement, consistency, and external academic circumstances.

12. Confidentiality

All information shared during tutoring sessions is considered confidential and used exclusively for educational purposes.

No information will be shared with third parties without the Client’s written consent unless required by law.

13. Limitation of Liability

The Company is not liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use tutoring services, including academic performance or loss of data.

14. Modifications to Terms

Xavier Ellsworth Tutoring Services reserves the right to amend these Terms and Conditions at any time.

Clients will be notified of material changes. Continued use of services following such updates constitutes acceptance of the revised terms.

15. Termination of Services

The Company reserves the right to suspend or terminate services at its sole discretion.

Clients may discontinue services at any time, provided they comply with the notice and cancellation policies outlined in this Agreement.

16. Dispute Resolution

In the event of a dispute, both parties agree to make a good-faith effort to resolve the issue through informal negotiation.

If resolution cannot be achieved, the matter shall be submitted to binding arbitration in accordance with the rules of a mutually agreed-upon arbitration body. The decision of the arbitrator shall be final and binding.

17. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of New York, without regard to its conflict of law principles.
