1. Academic Services

Xavier Ellsworth Tutoring Services provides personalized one-on-one academic instruction for students in Kindergarten through Sixth Grade. Services are designed to strengthen foundational skills, build confidence, and promote long-term academic success.Instruction may be provided in person or virtually, subject to availability and mutual agreement. Each learning experience is thoughtfully tailored to the student's unique academic needs, learning style, and educational goals.

2. Scheduling and Cancellations

Scheduling

A 10% reservation deposit is required to secure an instructional session. The deposit will be applied toward the total balance and is refundable when cancellations are made at least 24 hours in advance.All sessions must be scheduled through the official booking portal:https://xavierellsworthtutoringservicesbooknow.as.me/schedule/c2a3d2d5Appointments are subject to availability and are considered confirmed upon successful booking.

Cancellations and Rescheduling

A minimum of 24 hours' notice is required to cancel or reschedule a session.Cancellations made with less than 24 hours' notice will incur a cancellation fee equal to 50% of the scheduled session rate.

No-Shows

Failure to attend a scheduled session without prior notice will result in the full session fee being charged.

3. Lateness Policy

Late Arrivals

Sessions will conclude at the originally scheduled end time regardless of a student's arrival time. Session fees remain unchanged.

Excessive Lateness

If a student arrives more than 15 minutes late without prior communication, Xavier Ellsworth Tutoring Services reserves the right to cancel the session and charge the full session fee.

Notification

Families are encouraged to communicate delays as soon as possible. While session time cannot be extended, advance notice may allow for instructional adjustments.

4. Payment Terms

Payment is due upon completion of the instructional session unless alternative arrangements have been approved in writing by Xavier Ellsworth Tutoring Services.Accepted payment methods include:• Zelle

• Credit or Debit Card (processed through Square)Cash payments are not accepted.Outstanding balances must be paid before additional services can be scheduled.

5. Academic Program Enrollment and Membership Payments

Clients who enroll in academic programs or membership-based services agree to the payment terms outlined at the time of enrollment.Payment plans may be offered at the discretion of Xavier Ellsworth Tutoring Services and must be completed according to the agreed schedule.All academic programs and memberships are non-refundable once the first session has been scheduled.Missed or canceled sessions will count toward the total number of sessions included in the academic program unless canceled with at least 24 hours' notice.

Payment Plans

Clients are responsible for submitting payments according to the agreed-upon schedule.Failure to maintain payments may result in a temporary pause or discontinuation of services until the account is brought current.Late payments may incur a $15 administrative fee.By enrolling in an academic program or membership, clients acknowledge and accept these payment terms.

6. Former Student Recognition Rate

Students previously taught in a classroom setting by an instructor affiliated with Xavier Ellsworth Tutoring Services may be eligible for a 25% discount on the standard session rate using code FORMER25. Eligibility must be verified at the time of booking. If eligibility cannot be confirmed, the standard rate will apply.

7. Sibling Discount

Families scheduling services for multiple children may receive a 10% discount on sessions for each additional sibling using code SIBLING15.Eligibility is subject to verification. Unverified discounts will be removed and standard pricing will apply.

8. Family Recognition Rate

Immediate family members of current or former Xavier Ellsworth Tutoring Services students may be eligible to receive a 20% discount on the standard hourly rate using code FAMILY20.This discount applies to individual sessions and academic programs.Eligibility is subject to verification. Unverified discounts will be removed and standard pricing will apply.

9. Session Conduct

Students are expected to arrive prepared with all necessary materials, including assignments, notebooks, textbooks, and writing supplies.Students are expected to participate respectfully and engage meaningfully throughout each session.Xavier Ellsworth Tutoring Services reserves the right to conclude a session if a student's behavior significantly interferes with the learning environment or prevents productive instruction. In such cases, no refund or credit will be issued.

10. Parental Involvement

For students under the age of 18, a parent or legal guardian must authorize participation in tutoring services.For virtual sessions and certain in-home sessions, a parent or guardian may be required to remain accessible throughout the instructional period.Open communication between families and Xavier Ellsworth Tutoring Services is encouraged to support student success.

11. Academic Progress

Xavier Ellsworth Tutoring Services is committed to supporting meaningful academic growth and increased student confidence.While many students demonstrate measurable improvement through consistent participation and effort, specific grades, test scores, admissions outcomes, or academic results cannot be guaranteed.Student success is influenced by numerous factors, including attendance, effort, school-based instruction, study habits, and family support.

12. Confidentiality

Information shared during instructional sessions will be treated as confidential and used solely for educational purposes.Personal information will not be disclosed to third parties without written consent unless required by law.

13. Limitation of Liability

Xavier Ellsworth Tutoring Services shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from participation in tutoring services, including but not limited to academic performance, technology interruptions, scheduling conflicts, or data loss.

14. Modifications to Terms

Xavier Ellsworth Tutoring Services reserves the right to update or modify these Terms and Conditions at any time.Clients will be notified of material changes. Continued participation in services following such updates constitutes acceptance of the revised Terms and Conditions.

15. Termination of Services

Xavier Ellsworth Tutoring Services reserves the right to suspend or discontinue services when continued participation is determined to be inconsistent with the educational expectations, policies, or best interests of the learning environment.Clients may discontinue services at any time, provided they comply with the scheduling and cancellation policies outlined in this Agreement.

16. Dispute Resolution

In the event of a dispute, both parties agree to make a good-faith effort to resolve the matter through informal discussion and negotiation.If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with the rules of a mutually agreed-upon arbitration organization. The decision of the arbitrator shall be final and binding.

17. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of New York, without regard to conflict of law principles.
